Merkel deflects pressure to boost euro bailout funds (Reuters)

BERLIN (Reuters) ? Chancellor Angela Merkel tried to deflect growing international pressure on Germany to agree an increase in the euro zone's bailout funds Sunday by saying talks were still continuing.

Amid calls to raise the size of the permanent European Stability Mechanism (ESM) ahead of an EU summit Monday, Merkel was asked by Bild am Sonntag newspaper about "rising pressure" on Germany to "massively increase" the bailout fund.

But the chancellor did not address the issue of whether Germany would back raising the ESM and instead answered a question about what impact increasing the ESM might have on the German budget this year.

"The negotiations are continuing on whether we'll pay in our contribution in one tranche or two tranches," said Merkel, who has resisted calls for Germany to back increasing the bailout funds in part due to opposition in her center-right coalition.

"But independent of all that, our deficit level as far as the European Stability Pact is concerned will not be increased as a result because the money won't be gone. It's only to be transferred from the federal budget to the ESM."

Merkel is keen to avoid the EU summit being sidetracked by debate about whether extra funding should be funneled into the euro zone bailout funds, as the International Monetary Fund and some euro states -- including Italy and Spain -- have suggested.

A close Merkel ally in parliament, Peter Altmaier, said it made sense to first see how effective the ESM is.

"It would be good if we make good use of the amounts that are now available," Altmaier, a senior MP, told German radio.

Austrian chancellor Werner Faymann said in an interview in Der Spiegel news magazine he believed the 500-billion euro ESM firewall may need to be raised, echoing appeals made in Berlin by IMF head Christine Lagarde and Italian premier Mario Monti.

"I wouldn't promise my parliament that 500 billion euros will be enough," Faymann said, adding his government was preparing to contribute to a higher firewall by taking funds from the European Financial Stability Facility (EFSF).

"This is the direction it should go -- that way we'd come up with a total of about 750 billion euros," he said. "Financial markets are observing us closely and measuring how strong we are by looking at the size of the firewall. If it's too low, we'll be giving the markets a reason to speculate against us."

German government sources have told Reuters Merkel does not rule out boosting funds if the euro zone crisis deteriorates over the coming months. But only the threat of a disaster may persuade her coalition to back more funds for the currency bloc.

The German government believes that there should not be any discussions about increasing the firewall until March.

The leader of Germany's center-left opposition in parliament, Frank-Walter Steinmeier, said Merkel was making a mistake by resisting calls to raise the ESM.

"You can argue whether continually coming up with new bailout funds is the right way to go," Steinmeier told the Welt am Sonntag newspaper. "But for those who decide in a situation like this to set up a permanent bailout fund, they should realize that this one is definitely not big enough."

Steinmeier, foreign minister under Merkel in the 2005-2009 grand coalition and a possible challenger in 2013, said that Merkel had failed to inspire public confidence during Europe's worst post-war crisis, by repeatedly changing course.

"She has annoyed a lot of people and put them off on Europe by continuously changing direction," said Steinmeier.

"As Europe's strongest export nation we have a fundamental interest in preventing this crisis from becoming a permanent recession for all of Europe," he added. "If Europe isn't doing well, then Germany won't be doing well either."

Marine faces 3 months in brig for Iraqi deaths (AP)

CAMP PENDLETON, California ? Military prosecutors worked for more than six years to bring Marine Staff Sgt. Frank Wuterich to trial on manslaughter charges that could have sent him away to prison for life.

But only weeks after the long-awaited trial started, they offered Wuterich a deal that stopped the proceedings and could mean little to no jail time for the squad leader who ordered his men to "shoot first, ask questions later," resulting in one of the Iraq War's worst attacks on civilians by U.S. troops.

The 31-year-old Marine, who was originally accused of unpremeditated murder, pleaded guilty Monday to negligent dereliction of duty for leading the squad that killed 24 unarmed Iraqi civilians in the town of Haditha in 2005 during raids after a roadside bomb exploded, killing a fellow Marine and wounding two others.

Wuterich, who was indicted in 19 of the 24 deaths, now faces no more than three months in confinement.

It was a stunning outcome for the last defendant in the case once compared with the My Lai massacre in Vietnam. The seven other Marines initially charged were exonerated or had their cases dropped.

"I was expecting that the American judiciary would sentence this person to life in prison and that he would appear and confess in front of the whole world that he committed this crime, so that America could show itself as democratic and fair," one of the survivors, Awis Fahmi Hussein, told The Associated Press in Haditha.

Military judge Lt. Col. David Jones began hearing arguments from both sides Tuesday at Camp Pendleton, Calif., before making a sentencing recommendation to be considered by the commander of Marine Corps Forces Central Command.

Legal experts said the case was fraught with errors made by investigators and the prosecution that let it drag on for years. The prosecution was also hampered by squad mates who acknowledged they had lied to investigators initially and later testified in exchange for having their cases dropped, bringing into question their credibility.

In addition, Wuterich was seen as taking the fall for senior leaders and more seasoned combat veterans, analysts said. It was his first time in combat when he led the squad on Nov. 19, 2005.

Brian Rooney, an attorney for another former defendant, said cases like Haditha are difficult to prosecute because a military jury is unlikely to question decisions made in combat unless wrongdoing is clear-cut and egregious, like rape.

"If it's a gray area, fog-of-war, you can't put yourself in a Marine's situation where he's legitimately trying to do the best he can," said Rooney, who represented Lt. Col. Jeffrey Chessani, the highest-ranking Marine charged in the case. "When you're in a town like Haditha or Fallujah, you've got bad guys trying to kill you and trying to do it in very surreptitious ways."

Marine Corps spokesman Lt. Col. Joseph Kloppel said the deal was not a reflection or in any way connected to how the prosecution felt its case was going in the trial.

The Haditha attack is considered among the war's defining moments, further tainting America's reputation when it was already at a low point after the release of photos of prisoner abuse by U.S. soldiers at Abu Ghraib prison.

It still fuels anger in Iraq today.

"We wonder about such a sentence issued against the defendant. We called upon US to be fair in passing sentences. Regrettably, we are disappointed about the issuance of such sentences," said Khalid Salman Rasif, a member of the Provincial Council in Haditha, adding he would contact the lawyer for victims' families for an explanation.

Kamil al-Dulaimi, a Sunni lawmaker from the Anbar provincial capital of Ramadi, called the plea agreement proof that "Americans still deal with Iraqis without any respect."

"It's just another barbaric act of Americans against Iraqis," al-Dulaimi told The Associated Press. "They spill the blood of Iraqis and get this worthless sentence for the savage crime against innocent civilians."

Wuterich, the father of three children, had faced the possibility of life behind bars when he was charged with nine counts of manslaughter, which will be dropped. Along with facing a maximum of three months in confinement, he could also lose two-thirds of his pay and see his rank demoted to private when he's sentenced.

.Wuterich, his family and his attorneys declined to comment Monday after he entered the plea. Prosecutors also declined to comment on the plea deal.

During the trial before a jury of combat Marines who served in Iraq, prosecutors argued he lost control after seeing the body of his friend blown apart by the bomb and led his men on a rampage in which they stormed two nearby homes, blasting their way in with gunfire and grenades. Among the dead was a man in a wheelchair.

In the deal, Wuterich acknowledged that his orders misled his men to believe they could shoot without hesitation and not follow the rules of engagement that required troops to positively identify their targets before they raided the homes.

He told the judge that caused "tragic events."

"I think we all understood what we were doing so I probably just should have said nothing," Wuterich told the judge.

He said his orders were based on the guidance of his platoon commander at the time, and that the squad did not take any gunfire during the 45-minute raid.

Many of his squad mates testified that they do not believe to this day that they did anything wrong because they feared insurgents were inside hiding.

Haditha prompted commanders to demand troops be more careful in distinguishing between civilians and combatants.

Former Navy officer David Glazier said the case shows such rules are essential to helping the United States prevail in an armed conflict.

"The reality is that this incident has had significant consequences for the U.S. in Iraq," said Glazier, a professor at Loyola Law School in Los Angeles. "It probably fueled the resistance and so it probably ended up costing additional soldiers and Marines their lives later on."

Op-Ed: The Verdict Is In On Climate Change

California became the only state to implement greenhouse gas emission controls in January 2012, but the debate there over climate change continues. University of California history and science professor Naomi Oreskes says the time for bickering over whether or not climate change is real is over.

Disputes on climate change are often presented in the familiar paradigm of a court case with scientists as prosecutors, skeptics as the defense, and the rest of us the jury awaiting the ruling of a judge.

In an op-ed piece in The Los Angeles Times, historian Naomi Oreskes objects. She argues that most of the skeptics are shills, scientists are, in fact, the jury, and that their verdict has long since been handed down. Naomi Oreskes is the co-author of "Merchants of Doubt: How a Handful of Scientists Obscured the Truth About Climate Change," and joins us now from a winter vacation in Snowmass, Colorado. And thanks very much for taking a break today to speak with us.

NAOMI ORESKES: Thank you, Neal. Can you hear me?

CONAN: We can.

ORESKES: Good.

CONAN: And I have to say that while the vast majority of scientists agree the Earth is warming as a result of human activity, a vast majority does not mean unanimity. It's not unanimous.

ORESKES: No, of course not. And, you know, I'm a historian of science. Most of my work is focused on the question of how scientists do evaluate evidence and judge the data that they collect from the natural world. And, so of course, in any scientific community, there will always be people who have dissenting opinions, and that's fine. Nobody really has a problem with that. The problem is when it's misrepresented. The problem is when a normal give and take of scientific debate is misrepresented to make it seem different than it really is.

So in the scientific community today - and not just today, but actually for the last 10 years at least if not longer - there has been a general consensus that climate change was underway. And we're talking about climate change caused by things that people do. Not the normal ups and downs of weather and natural variability, but a different new phenomenon caused by greenhouse gases and deforestation. There has been general agreement in the scientific community about this issue for quite some time now. The vast, vast majority of scientists who work on this issue would agree with that statement.

CONAN: And you draw, again, an analogy to a court case, you were serving as a juror recently and say that, you know, in a sense, we should not be open-minded. What did you mean by that?

ORESKES: Well, right. And I was, of course, being a little deliberately provocative, but the point I was trying to make was drawing on an analogy with the jury. This was a great experience because we had a wonderful judge, and one of the things she said to us at the very beginning - and I wrote about this in the op-ed piece - she asked us at the very beginning during jury selection: If I sent you out right now and then asked you to come back - and this is before we turn any evidence and before the jury had even been impaneled - if I asked you, do you think these people, the defendants, are guilty, not guilty or you don't know enough to know. And the vast majority of people in the room raised their hands for we don't know enough to know. And the judge said: That's the wrong answer, that in this case, open-mindedness is not the correct answer because the law establishes a presumption of innocence.

The law tells us that those defendants are innocent, presumed innocent until the prosecution has proved the case beyond a reasonable doubt. And it was a kind of eureka moment for me because I thought, oh, of course, the judge is completely correct here. We think of open-mindedness as a virtue. And in many walks of life it is a virtue, but there are some situations when the situation calls for something else. In the courtroom, it calls for us to assume that the defendants are innocent until the state makes its case against them.

So then I thought about, well, what about in the case of science? Well, science is a little different. It's not exactly the same as a courtroom. Innocence and guilt don't really make much sense when we're talking about science in the natural world. So then the question becomes, well, who is making this judgment? And so the argument I was trying to point out is that, as ordinary citizens, many of us feel, well, we don't know what to think. You know, we've heard a lot of conflicting things about climate change so - and I've heard many people say to me, I'm open-minded about it.

And so the argument I was trying to make was to say, well, in this case, being open-minded - although it might sound good at first and may sound good in principle - it actually doesn't make sense when you have now more than half a century of accumulated scientific data put together by thousands of different scientists all around the world, men and women, black and white, Republicans, Democrats, you know, all, you know, very diverse scientific community, over half a century of work. At this point, to say that you're still open-minded is to really be ignoring this huge body of scientific evidence that really points to a very, very strong conclusion.

CONAN: Naomi Oreskes, professor of history and science, professor at the University of California, San Diego. You're listening to TALK OF THE NATION from NPR News. If the evidence is so overwhelming, why is it that this argument seems to be losing traction?

ORESKES: Right. Well, this is the subject of a book which I published last year with my co-author Erik Conway called "Merchants of Doubt." And in the book, we asked exactly that question. We said, well, if there's so much scientific evidence, why do so many of us have the impression of a raging scientific debate? And so we've spent five years researching this question. And, you know, it's funny for me because it's funny for me to even be having to have this conversation, because I first published on the scientific consensus on climate change back in 2003. So I've now been working on the consensus piece for almost a decade.

But for the last five years, Erik Conway and I have been working on this question why so many of us think there's a raging debate. And what we showed in the book is that there have been systematic efforts organized by people outside the scientific community to undermine the scientific data and to convince all of us that the jury - scientific jury was still out in order to delay government, business and community action on taking steps to prevent further manmade climate change.

CONAN: A conspiracy theory.

ORESKES: No, it's not a conspiracy theory. It's a history. We're describing events that had happened. We're describing the things that people have done. There are organizations. There are networks. It's not a conspiracy in the sense that it's not taking place in smoke-filled rooms. In fact, one of the sort of remarkable things about our book was that we were able to show how much of this activity took place in open air, in plain sight. A lot of the research we did wasn't actually that difficult to do. Many of the documents we found were in the public record.

So it's not a conspiracy in the sense of, you know, creepy, evil people in backrooms doing terrible things. No. It's actually out in the open, which in some ways makes it more shocking and in a way more alarming that the media haven't done more to talk about the events that have actually taken place in the last five years to convince the American people that there was a debate, you know, an argument that really flew in their face of a huge amount of evidence.

CONAN: There is a - your case is not bolstered when stories come out. This publication of emails by scientists in England who seem to be, though not fabricating data, suppressing publication of data that seem to fly in the face of their conclusions.

ORESKES: Well, exactly. And, of course, this is where the media has played a huge role because that is exactly how the story was told in the media, you know, a year or so ago. But what we know now from many different investigations that have taken place, including the House of Lords in Britain, is that those emails were completely taken out of context, very much misrepresented. And what was the real give and take of scientific debate and also the real frustration that scientists feel at the misrepresentation of their work was taken massively out of context.

And, you know, you mentioned that this took place in England. Earlier in your show, you mentioned that Meryl Streep has - had her 17th Oscar nomination for portraying Prime Minister Margaret Thatcher. And I thought, you know, that's a great thing to remind people about because Margaret Thatcher was one of the first political leaders to understand the threat of the human-caused climate change.

And she created the climate research university at East Anglia, where these emails were stolen from. Created that institute more than 30 years ago to ask and answer this exact question: How do we tell the difference between natural climate variability that takes place all the time - normal, natural climate change - versus what we could call abnormal or even synthetic climate change that has been caused by greenhouse gases and deforestation? That was the question that Mrs. Thatcher posed to the British scientific community more than 30 years ago. And that question has really been answered beyond a reasonable doubt.

CONAN: You also, speaking of smoke-filled rooms, draw an analogy to the so-called debate over tobacco's health.

ORESKES: Well, exactly. And this was a major topic in our book. And that's where the true conspiracy, of course, comes in because the tobacco industry, the American tobacco industry was in fact found guilty by the U.S. Department of Justice, charged under the RICO statute with criminal conspiracy to defraud the American people. And one of the things we were able to show in the book is that some of the exact same people, not just the same tactics, but actually the same individuals who had worked in the tobacco industry and developed the strategy, for which they were convicted of criminal conspiracy by the U.S. Department of Justice, those same people have been involved in some of the attempts to undermine and challenge the scientific evidence of human-caused climate change.

CONAN: Naomi Oreskes, thanks very much. We'll let you get back to your vacation.

Ukraine's Yanukovich refuses to relent in Tymoshenko case (Reuters)

KIEV (Reuters) ? Ukrainian President Viktor Yanukovich appeared on Sunday to rule out any prospect of opposition leader Yulia Tymoshenko being freed, saying those responsible for signing a 2009 gas deal with Russia on "enslaving" terms should be punished.

Tymoshenko, in a statement from prison where she is serving a seven-year jail sentence, called on all opposition forces to unite to defeat Yanukovich's Regions Party in a parliamentary election next October.

Her jailing last October for abuse of office, linked to the 2009 gas contract she brokered as prime minister, has led to a crisis in relations between the ex-Soviet republic and the West.

The United States and the European Union say the trial was politically motivated; in December the EU withheld completion of agreements on political association and a free trade zone with Ukraine in protest over her jailing.

Tymoshenko's trial and conviction are widely seen as a settling of scores between rival groups in the ex-Soviet republic.

Tymoshenko was a key player in the "Orange Revolution" street protests in 2004-2005 which overturned Yanukovich's first bid for the presidency. He made a comeback and narrowly defeated her in a run-off vote in February 2010.

Despite the EU pressure, justice officials have opened fresh criminal cases against Tymoshenko and she has been moved from police detention in the capital, Kiev, to a remote prison camp in Kharkiv, some 500 km (310 miles) to the east.

The Ukrainian leadership says the 2009 gas deal saddled the country with an exorbitant price for gas and committed it to importing volumes of Russian gas it does not need.

"Ukraine has become hostage to enslaving gas agreements ... which have caused the country huge losses, billions of losses. We have been left with a huge external debt. Those who, regardless of their office, pushed Ukraine to the abyss must bear responsibility before the Ukrainian people," Yanukovich told a ceremony on Sunday.

Several thousand opposition supporters used a rally in the centre of Kiev, marking the day when eastern Ukraine joined the west of the country, to protest at the government's policies and call for Tymoshenko to be freed.

In a statement read out to the crowd, Tymoshenko called on all opposition parties to unite in a single democratic opposition force. "One team - one victory - this is the only slogan with which the opposition should arm itself today," she said.

In what might prove to be a significant development in the coming months, several opposition parties later issued a statement saying they would unite to field a single candidate in single-mandate constituencies at next October's election.

These will account for half the seats in the Ukraine parliament, the other half coming from party list voting.

The popularity of Yanukovich's Regions Party is sagging at present, and a united opposition might make it difficult for the Regions Party to re-establish a stranglehold on parliament after the election.

Tymoshenko's daughter told Reuters last week that her mother's life was "at risk" in the Kharkiv jail where she is being held because of her deteriorating health.

She said her mother had been unable to get up unaided since early November because of recurring back pain.

'Underworld' sinks teeth into box office with $25M

LOS ANGELES (AP) ? Kate Beckinsale is back with a vengeance, with her latest "Underworld" movie opening at No. 1 this weekend.

"Underworld Awakening" made an estimated $25.4, distributor Sony Screen Gems reported Sunday.

This is the fourth film in the vampire action saga. Beckinsale starred in the first two movies as the warrior Selene, then bowed out of part three but returned for this latest installment. "Underworld Awakening" was shown for the first time in 3-D as well as on IMAX screens, where it made $3.8 million. That's 15 percent of the film's weekend gross, which is a record for an IMAX digital-only run.

Sony had hoped the film would end up in the low-$20 million range. But Rory Bruer, the studio's president of worldwide distribution, says the fact that it did even better ? despite a snow storm that hit much of the Midwest and East Coast ? primarily has to do with Beckinsale's return.

"She is such a force. Her character ? you just can't take your eyes off of her. I know the character is very dear to her, as well, and she just kills it," Bruer said. "The 3-D aspect of the film also brings something, makes it a fun, visceral ride."

Opening in second place was "Red Tails" from executive producer George Lucas, about the Tuskegee Airmen who were the first black fighter pilots to serve in World War II. It made an estimated $19.1 million, according to 20th Century Fox, which was well above expectations; the studio had hoped to reach double digits, said Chris Aronson, executive vice president of domestic distribution.

"I believe what George Lucas has stated all along: This is an important story and a story that must be told. It is a true story of American heroism and valor and audiences have really responded to this message," Aronson said. "People want to feel good about themselves, they want to be uplifted. We have enough hard crud going on in this country right now. Times are tough, and if we look back and are told a story of some really fantastic deeds, that's really compelling moviegoing."

Hollywood.com analyst Paul Dergarabedian said a grassroots effort to get groups of people into the theaters to see "Red Tails," along with positive word-of-mouth, helped its strong showing. The film saw an uptick from about $6 million on Friday to $8.65 million on Saturday.

Overall box office is up 31 percent from the same weekend a year ago, Dergarabedian said, thanks to new releases as well as movies like "Extremely Loud & Incredibly Close," which had limited runs for awards consideration at the end of 2011 and are now expanding nationwide. The Sept. 11 drama from Warner Bros., starring Tom Hanks and Sandra Bullock, came in fourth place with $10.5 million.

Last week's No. 1 film, the Universal smuggling thriller "Contraband" starring Mark Wahlberg, dropped to the No. 3 spot with $12.2 million. It's now made $46.1 million in two weeks. Meanwhile, Steven Soderbergh's international action picture "Haywire" from Relativity Media, starring mixed martial arts superstar Gina Carano in her first film role, opened in fifth place with $9 million, which was above expectations.

"This is a great, perfect January weekend. You've got these holdover films and newcomers creating an overall marketplace that people are really responding to," Dergarabedian said. "It sounds cliche but this marketplace really has something for everyone."

As for worldwide box office, "The Twilight Saga: Breaking Dawn ? Part 1" has now crossed the $700 million mark. The first half of the finale of the girl-vampire-werewolf love triangle franchise has grossed an estimated $701.3 million in global box office receipts since its release last November, according to Lionsgate, which recently acquired Summit Entertainment, which distributes the series.

Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

Google results fall short, rare miss hurts shares (Reuters)

SAN FRANCISCO (Reuters) ? Google Inc's quarterly results fell short of Wall Street's heightened expectations for the holiday season as declining search advertising rates contributed to a rare miss, triggering a 9 percent slide in its shares.

The No. 1 Internet search engine underperformed on both revenue and earnings in the fourth quarter, disappointing investors who had counted on record U.S. online-commerce to prop up results.

Several analysts zeroed in on an 8 percent drop in cost-per-click, or money paid by marketers to the company for search ads, versus analyst estimates of a slight increase.

"The major question is: Is this a one-time thing or is this something that is going to continue because the nature of the business has changed," said Mayuresh Masurekar, an analyst at Colins Stewart.

Google executives reeled off a number of figures during the conference call that highlighted the company's progress in newer businesses such as display advertising, mobile and social networking.

But the good news did not offset concerns about Google's first year-on-year decline in its CPCs in more than two years, leading to nearly a half-dozen questions from analysts during the call and a terse one-liner from Chief Executive Larry Page who at one point requested that "maybe we can get our next question not about CPCs."

Google executives said the decline in search ad rates was primarily due to the impact of foreign currency exchange fluctuations and changes to the company's advertising formats.

The new ad formats drove a sharp increase in the total number of clicks by websurfers on Google's search ads - up 34 percent year-on-year - even though some of the format changes impacted prices negatively, Google executives explained.

But many analysts wondered whether Google's mobile advertising, which is generally believed to command lower ad rates, played a bigger part in the CPC decline than Google let on.

"This was the first time we've seen a decline in CPC rates since 2009," said Needham & Co analyst Kerry Rice. "It's been a long time and the one thing that's really changed about this is mobile."

Google's shares dived to about $583 in after-hours trade, from the Nasdaq close of $639.57 before the results.

Dave Rolfe, manager of RiverPark-Wedgewood Fund which counts Google as one of its largest holdings, said the stock decline was an "egregious overreaction" by Wall Street and that the declining ad rates did not shake his confidence in the company.

"The company tried to clarify it as best as they could, but it's Google and they're not going to give you every little nuance of it," he said.

"Google is famous for making improvements for their end-users that have short term negative results," he said.

SOCIAL ENGAGEMENT

Google is increasingly investing in mobile and social networking initiatives as it positions its business for new technology trends and squares off against rivals Apple and Facebook.

Google's business providing graphical display ads is generating revenue at a $5 billion annualized run rate, Page said during the call. That's up from the $2.5 billion run rate in October 2010, the last time Google provided a peek at the display business's financial performance.

Google+, the company's recently-launched social network, now has more than 90 million users, compared to 40 million users three months ago.

Perhaps more importantly, Google for the first time provided details about how often people actually use Google+.

According to the company, 60 percent of Google+ members use the service every day, and 80 percent use it every week.

That "engagement" on the social network, which Google hopes can eventually take on Facebook, is key to determining future revenue potential.

"Google+ investments are showing some results. They are investing in future revenue growth," said Global Equities Research analyst Trip Chowdhry.

Operating expenses increased to 32 percent of revenue during the fourth quarter, from 30 percent of revenue in the year-ago quarter.

Google said on Thursday it earned $2.71 billion, or $8.22 per share, in the fourth quarter, compared with $2.54 billion, or $7.81 per share, a year earlier.

Excluding certain items, Google earned $9.50 per share, lagging estimates for $10.49 a share.

Page, who took over as CEO in April, said the company was making tough choices about where to focus its efforts, pulling the plug on less successful products so that Google can "double down on the really big bets we have made."

Wall Street is still uneasy about one of Google's biggest bets: its planned $12.5 billion acquisition of smartphone maker Motorola Mobility Holdings. Investors are worried that Google is entering a lower-margin business in which it has no experience, and that the deal might alienate partners that license Google's Android mobile software.

In response to a question on the subject, Page said that he expected Google's relationships with its partners to remain strong once the deal closed, and reiterated that Motorola would be run as a separate company.

Google executives said more than 250 million devices powered by Android, Google's freely distributed smartphone operating system, had been activated since its inception.

"Android is quite simply mind boggling," said Page.

Google's net revenue, which excludes fees shared with partner websites, was $8.13 billion in the fourth quarter, versus $6.37 billion a year earlier. Analysts polled by Thomson Reuters I/B/E/S were looking for $8.4 billion.

That shortfall marks an unusual slip-up for a company that has exceeded Wall Street's revenue targets for eight consecutive quarters.

More Americans Practicing Safe Sex, CDC Reports (HealthDay)

THURSDAY, Jan. 19 (HealthDay News) -- The number of Americans who practice behaviors that put them at risk for HIV infection has declined significantly, federal health officials reported Thursday.

The ranks of those engaging in a risky sexual or drug-related behavior dropped from 13 percent of men and 11 percent of women in 2002 to 10 percent and 8 percent, respectively, in 2010, according to the U.S. Centers for Disease Control and Prevention.

"Generally, these are behaviors that are studied in higher risk populations, but by looking in the household population we can get a better sense of the level of risk that may exist in the general population that you don't normally think about," said report author Anjani Chandra, a health scientist at the CDC's National Center for Health Statistics.

Some of the risk factors the researchers looked at were gay and bisexual sex, illicit drug use and having several sexual partners or a partner who injects illegal drugs, she said.

"For women, we don't really see that the decline is due to any variation in sexual risk behaviors, whereas for men we see substantial difference by race," she said.

The reasons for the decline in risk behaviors is not clear, Chandra said. Some of the public health messages might be getting through. It also could be that people are reluctant to disclose that they engage in risky behaviors, she said.

"But, it could be real and reflect actual changes in behavior," she said.

The data in the report was collected on almost 23,000 men and women aged 15 to 44 in households throughout the country and represents 6.5 million men and 4.9 million women.

The decline seems to be due to a drop in risky behaviors such as having unprotected sex and having sex with multiple partners, Chandra said.

There were, however, differences in behaviors in different groups. For example, men who had recently been in prison were more likely to report engaging in one or more HIV risk behaviors, compared with other men, the researchers found.

There were also significant variations based on race and income level, they reported.

Sixteen percent of young black men ages 15 to 24 reported at least one HIV risk-related sexual behavior, compared with 8.7 percent of Hispanic men and 6.5 percent of young white men. Poorer men were also more likely to engage in risky behaviors.

The HIV risk in households is not something one usually thinks about when one thinks about HIV risk, Chandra said.

"In household populations, where you may think these behaviors are nonexistent or very rare, they are occurring and they may be placing people at risk of HIV and other sexually transmitted diseases," Chandra said. "Just focusing on high-risk populations may not take care of the concerns that we have."

Dr. Sten Vermund, director of the Institute of Global Health at Vanderbilt University School of Medicine in Nashville, said that the data used was "a highly valid sample of the American population."

Both sexual and drug-related risk behaviors declined in the study period, and that is a positive trend, he said.

"Risk behaviors remain high and the likelihood of encountering an HIV-infected person has never been higher," Vermund noted. "Nonetheless, there is a strong indication that prevention programs are working or cultural norms are shifting, or both."

Philip Alcabes, an associate professor in the School of Health Sciences at Hunter College/City University of New York, is critical of the report as another example of how the government still avoids the real problem of HIV.

"What a waste of time and taxpayer dollars," he said. "Having failed to advocate for structural changes that would actually reduce risk of HIV acquisition and having failed to implement widespread, easily accessible syringe exchange programs, federal agencies instead spend their time studying personal behavior. It's a shame."

"Even though our officials don't have a clear concept of what really happened 30 years ago, they are still looking at AIDS through the same moralizing lens that was common in 1981. That's sad, and disturbing," he said.

WASHINGTON (AP) ? In a politically explosive decision, President Barack Obama on Wednesday rejected plans for a massive oil pipeline through the heart of the United States, ruling there was not enough time for a fair review before a looming deadline forced on him by Republicans. His move did not kill the project but could again delay a tough choice for him until after the November elections.

Right away, the implications rippled across the political spectrum, stirred up the presidential campaign and even hardened feelings with Canada, a trusted U.S. ally and neighbor. For a U.S. electorate eager for work, the pipeline has become the very symbol of job creation for Republicans, but Obama says the environment and public safety must still be weighed too.

The plan by Calgary-based TransCanada Corp. would carry tar sands oil from western Canada across a 1,700-mile pipeline across six U.S. states to Texas refineries.

Obama was already on record as saying no, for now, until his government could review an alternative route that avoided environmentally sensitive areas of Nebraska ? a route that still has not been proposed, as the White House emphasizes. But Obama had to take a stand again by Feb. 21 at the latest as part of an unrelated tax deal he cut with Republicans.

This time, the project would go forward unless Obama himself declared it was not in the national interest. The president did just that, reviving intense reaction.

"This announcement is not a judgment on the merits of the pipeline, but the arbitrary nature of a deadline that prevented the State Department from gathering the information necessary to approve the project and protect the American people," Obama said in a written statement. "I'm disappointed that Republicans in Congress forced this decision."

Republicans responded unsparingly.

"President Obama is destroying tens of thousands of American jobs and shipping American energy security to the Chinese. There's really just no other way to put it. The president is selling out American jobs for politics," House Speaker John Boehner, R-Ohio, said. Insisting that the pipeline would help the economy, he declared: "This is not the end of the fight," signaling that Republicans might try again to force a decision.

The State Department said the decision was made "without prejudice," meaning TransCanada can submit a new application once a new route is established. Russ Girling, TransCanada's president and chief executive officer, said the company plans to do exactly that. If approved, the pipeline could begin operation as soon as 2014, Girling said.

It did not take long for the Republicans seeking Obama's job to slam him.

Newt Gingrich, campaigning for the GOP presidential nomination in South Carolina, called Obama's decision "stunningly stupid," adding: "What Obama has done is kill jobs, weaken American security and drive Canada into the arms of China out of just sheer stupidity."

Republican presidential front-runner Mitt Romney said the decision was "as shocking as it is revealing. It shows a president who once again has put politics ahead of sound policy."

Project supporters say U.S. rejection of the pipeline would not stop it from being built. Canadian Prime Minister Stephen Harper has said Canada is serious about building a pipeline to its West Coast, where oil could be shipped to China and other Asian markets.

Harper on Wednesday told Obama he was profoundly disappointed that Obama turned down the pipeline, Harper's office said.

Alex Pourbaix, TransCanada's president for energy and oil pipelines, said last week the company soon will have a new route through Nebraska "that everyone agrees on."

The proposed $7 billion pipeline would run through Montana, South Dakota, Nebraska, Kansas and Oklahoma en route to Texas.

The pipeline is a dicey proposition for Obama, who enjoyed strong support from both organized labor and environmentalists in his winning 2008 campaign for the White House.

Environmental advocates have made it clear that approval of the pipeline would dampen their enthusiasm for Obama in the upcoming November election. Some liberal donors even threatened to cut off funds to Obama's re-election campaign to protest the project, which opponents say would transport "dirty oil" that requires huge amounts of energy to extract.

But by rejecting the pipeline, Obama risks losing support from organized labor, a key part of the Democratic base, for thwarting thousands of jobs.

"The score is Job-Killers, two; American workers, zero," said Terry O'Sullivan, general president of the Laborers' International Union of North America.

O'Sullivan called the decision "politics at its worst" and said, "Blue collar construction workers across the U.S. will not forget this."

Yet some unions that back Obama oppose the pipeline, included United Auto Workers, Service Employees International Union and Communications Workers of America.

TransCanada says the pipeline could create as many as 20,000 jobs, a figure opponents say is inflated. A State Department report last summer said the pipeline would create up to 6,000 jobs during construction.

Obama appeared to have skirted what some dubbed the "Keystone conundrum" in November when the State Department announced it was postponing a decision on the pipeline until after this year's election. Officials said they needed extra time to study routes that avoid an environmentally sensitive area of Nebraska that supplies water to eight states.

The affected area stretches just 65 miles through the Sandhills region of northern Nebraska, but the concerns were serious enough that the state's governor and senators opposed the project until the pipeline was moved. The new route, which has not been chosen, would have to be approved by Nebraska environmental officials and the State Department, which has authority because the pipeline would cross an international border.

Obama said his decision does not "change my administration's commitment to American-made energy that creates jobs and reduces our dependence on oil."

To underscore the point, Obama signaled that he would not oppose development of an oil pipeline from Oklahoma to refineries along the Gulf of Mexico. TransCanada already operates a pipeline from Canada to Cushing, Okla.

Refineries in Houston and along the Texas Gulf Coast can handle heavy crude such as that extracted from Canadian tar sands ? the type of oil that would flow through the Keystone XL pipeline.

Sen. Kent Conrad, D-N.D., said he doesn't believe the Keystone XL is a dead project. He said the Obama administration did not have enough time to review the project, given the Republican-imposed timeline.

"I don't believe this is the end of the story," Conrad told The Associated Press. "My personal view is that it should be constructed. It's clear Canada is going to develop this resource, and I believe it is better for our country to have it go here rather than Asian markets."

Bill McKibben, an environmental activist who led opposition to the pipeline, praised Obama's decision to stand up to what he called a "naked political threat from Big Oil." Jack Gerard, the oil industry's top lobbyist, had said last week that Obama faced "huge political consequences" if he rejected the pipeline.

"It's not only the right thing, it's a very brave thing to do," McKibben said. "That's the Barack Obama I think people thought they were electing back in 2008."

Coalition touts renewable energy for Maine (AP)

AUGUSTA, Maine ? A coalition that's pushing for a referendum to mandate increased use of renewable energy in Maine says its initiative would reduce dependence on foreign oil, strengthen the economy and promote energy efficiency.

The Maine Citizens for Clean Energy held a news conference Wednesday in support of a referendum proposal to require that at least 20 percent of Maine's electricity come from new renewable energy sources by 2020. Leaders of the initiative said they're confident they'll collect more than 57,000 valid signatures needed by the end of January to get the question on the ballot.

Environment Northeast's Maine director, Beth Nagusky, said Wednesday that residential electric bills would rise initially, but then decrease if the measure passes.

Gov. Paul LePage says the initiative would result in increased energy costs.

Great Computer for a College Student I'm an IT major in college and my laptop died midway through the semester. I needed a laptop as soon as possible so I didn't have much time to research different computers. I chose this one because it was the best price I could find for the features offered. I've had it for about a month now, and so far it's been great. The battery lasts about 3 hours which is a huge plus since my old one couldn't be unplugged for more than 5 minutes before dying. I had the setup complete as well as my printer and USB aircard installed within 20 minutes max. It's great for writing papers, especially since it comes with Microsoft Office Starter, which includes Word and Excel, instead of the annoying trial version that only lasted for so many days. I've only had one minor issue: There are only 3 USB ports, but it hasn't been as much of a problem as I expected, and if it becomes one I can always buy a USB hub. I???m really happy with my purchase and would definitely recommend this laptop. 11/19/2011

So far, pretty awesome For the price this laptop has been amazing. It is fast, easy to use, and nice to look at. So far the battery life has been great, especially comparing it to the gateway laptop I had previously. Also, it has an HDMI hookup so I can hook it up to my tv to watch videos and play games. I'm very pleased with the purchase. 11/20/2011

On the basic laptop, there is no backlight for the keyboard. Difficult to use keyboard if even semi-dark. All other aspects of the laptop are Excellent! 11/12/2011
